Enemy Combatant?? Jose Padilla's Lawyers Look To Have His Case Dismissed Due To Torture

Jose Padilla, a man whom the Bush Adminstration claimed to be an "unlawful enemy combatant" of the United States has been unconstitutionally held in solitary confinement for the past 42 months, even though the intial charges against him have been dropped.

Just a week prior to Padillo's attorney, Michael Caruso, filing a brief which asked for the case against Padillo to be dropped, "Congress passed the Military Commissions Act of 2006, which codifies in US law the concept of 'unlawful enemy combatant' and sanctions the continued torture of prisoners held by the American military and intelligence agencies. It denies people held at Guantanamo Bay and other US prison camps the fundamental right of habeas corpus—the right to challenge their detention in court—and deprives them of basic due process protections guaranteed by the US Constitution."

The brief filed on behalf of Padillo describes "a systematic mental and physical torture, including prolonged isolation, shackling and stress positions, and the administration of psychotropic drugs."

It's clear that Bush and far too many members of Congress are abusing the American system of juris prudence, by passing such unconstitutional legislation. Torture is inhumane, and any person or persons who would sanction such acts of violence are guilty of crimes against humanity. What is most disturbing here is that the United States Congress would have even considered such horrific legislation, much less passing it into law.
